Notice of Adoption of a Resolution Designating the “Benteler III Economic Revitalization Area” and Notice of Public Hearing

The Goshen Common Council passed Resolution 2020-01 on January 7, 2020 declaring the designation of the Benteler III Economic Revitalization Area at 910 Eisenhower Drive South, Goshen, Indiana for the purpose of phasing-in certain personal property taxes in connection with the installation of new
manufacturing equipment by Benteler Automotive Corporation (“Benteler”).

A description and map of the proposed economic revitalization area is available and can be inspected at the Elkhart County Assessor’s Office at 117 North Second Street, Goshen, Indiana. Resolution 2020-01 in its entirety may also be inspected during regular business hours at the Goshen Clerk-Treasurer’s Office at 202 South Fifth Street, Goshen, Indiana.

The Goshen Common Council will hold a public hearing at a meeting on February 4, 2020 at 7 p.m. to receive and hear all remonstrances and objections from interested persons concerning this designation. The hearing will be held in the City Court Room/Council Chambers at the Goshen Police & Court Building, 111 East Jefferson Street, Goshen, Indiana. After considering the evidence, the Common Council will take final action in determining whether the qualifications for an economic revitalization area have been met, and will then confirm, modify and confirm, or rescind the previously adopted resolution.

If the designation of the Benteler III Economic Revitalization Area to authorize a tax phase-in for Benteler is confirmed without modification by the Common Council, the designation shall be limited for a period of five (5) years and expire in 2026. Benteler will be entitled to make application for a deduction from the assessed value of the personal property applicable to the new manufacturing equipment installed for five (5) years in accordance with the approved tax abatement schedule in an amount not to exceed a cost of $26,064,506.

Pursuant to the provisions of the Open Door Law and Indiana Code 5-14-1.5-5, the Goshen Redevelopment commission will hold a public meeting on Thursday, February 21, 2019 at 3:00 p.m. at the City Courtroom/Council Chambers, 111 East Jefferson Street, Goshen, Indiana.

WEEK OF DEC. 16 LAST FOR LEAF PICKUP

Monday, December 16 will start the last week of leaf collection for the Street Department.

Rake leaves into long piles on the grass next to the street or sidewalk beside the curb, not more than 6 feet from the curb. For the safety of pedestrians and bicyclists, if you must pile leaves on the sidewalk, please leave as wide a walking path as possible.

Leaves must be kept out of the street. Residents and property owners that have a storm drain in front of their property are asked to keep the drain area clear of leaves. This will help reduce the chances of water backing up on City streets. Bagged leaves will be collected, but it slows the city-wide collection down drastically. The leaf vac crew has to empty the bags out in order to vacuum up the leaves and they will leave the bags on the property.

Do not place leaves in the alley—they will not be removed. Do not put sticks, twigs and other trash into or on top of the leaf piles. These items can damage the vacuum equipment and force crews to pluck these items from the leaves—another time-consuming task.

Located at 20100 CR 19, the Goshen Environmental Center accepts brush and leaves, loose or in bags, at no charge to Goshen residents. The Environmental Center is open 52 weeks a year. Winter hours are in effect from Dec. 1st through March 31st with hours being Monday – Friday 8:00 am to 4:00 pm. Their number is number is 533-6200.

NOTICE OF ADOPTION OF ORDINANCE 5021

Ordinance 5021, Amend Park Rules and Regulations to Allow Electric Bicycles and Change Park Hours, was passed by the Goshen Common Council on December 3, 2019 and approved and adopted by Mayor Jeremy Stutsman. Ordinance 5021 amends the Goshen City Code Section 7.1.1.2 to clarify park hours of operation, and Section 7.1.1.14 to permit the use of Class 1 and Class 2 electric bicycles on city bicycle/pedestrian trails. Ordinance 5021 is available for inspection in its entirety during regular business hours at the Goshen Clerk-Treasurer’s Office located at 202 South Fifth Street, Goshen, Indiana.

NOTICE OF PUBLIC HEARING

The Goshen Economic Development Commission (“Commission”) will hold a public hearing at 6:00 p.m. on December 17, 2019, in the City Court Room/Council Chambers at the Goshen Police & Court Building, 111 East Jefferson Street, Goshen, Indiana, regarding the issuance and funding of revenue bonds (“Bonds”) for the financing of economic development facilities in the City of Goshen.

The proceeds of the Bonds in an amount not to exceed Twenty-two Million Dollars ($22,000,000) will be loaned to Green Oaks of Goshen, LLC (“Borrower”) to provide a portion of the funds to pay the costs of acquisition, design, construction, improvement and/or equipping of the assisted living facilities to be located in the City at or near 282 Johnston Street, Goshen, Indiana, consisting of approximately 120 assisted living units and certain functionally related improvements (“Development”). The Bonds will be special obligations secured by and payable solely from loan payments paid by Borrower and will not be general obligations of the City.

The Commission will consider whether the acquisition, design, construction and/or equipping of the Development will have an adverse competitive effect on any similar facility already constructed or operating near or in the City. If the Commission shall find for itself and on behalf of the City, that the proposed financing will be of benefit to the health and welfare of the City and complies with the purposes and provisions of Indiana Code § 36-7-11.9 and 36-7-12, the Commission will adopt a resolution approving the proposed financing and the form and terms of financing documents, and shall transmit the resolution to the Goshen Common Council for consideration together with the form of the proposed inducement resolution to be recommended to the Council.

The public is invited to attend the public hearing and comment on any of the matters addressed.

The Goshen Redevelopment Commission is soliciting proposals to purchase 401, 405, 409, and 411 South Third Street and 204 West Madison Street, Goshen, Indiana.  Informational packages describing the requirements for the proposals may be obtained from Mark Brinson, Community Development Director, 204 E. Jefferson St., Ste 6, Goshen, IN 46528 (574-537-3824).

Written proposals must be submitted to Mark Brinson, Community Development Director, 204 E. Jefferson St., Ste. 6, Goshen, IN 46528 on or before 12:00 p.m. on Tuesday, November 12, 2019.  The proposals will be opened at the Redevelopment Commission meeting at 3:00 Tuesday, September 10, 2019.  The meeting will be held at the Goshen Police & Court Building in the City Court Room/Council Chambers, 111 E. Jefferson St., Goshen. 

All proposals shall meet the requirements set forth in the solicitation.  A proposal submitted by a trust (as defined by IC 30-4-1-1(a)) must identify the beneficiary of the trust and settlor empowered to revoke or modify the trust.  The City reserves the right to waive (but is not required to waive) any inconsistency between any proposal submitted and the requirements contained in the solicitation.
