Notice to Bidders: Purchase of UHF Digital Radio System for Street Department

 The City of Goshen, I The City of Goshen, Indiana is soliciting sealed proposals until January 23, 2025 at 4:00 p.m. (local time) for the above referenced purchase in accordance with the detailed specifications included in the Specification and Contract Documents. 

Specifications and Contract Documents for this purchase may be obtained from the Goshen Clerk-Treasurer’s Office at 202 South Fifth Street, Goshen, IN 46528 or the City of Goshen’s website at https://goshenindiana.org/bidding-opportunities. The City shall not be responsible for documents obtained from any other source. 

A sealed proposal must be submitted in accordance with the Instructions and all contractual terms and conditions that are included in the Specifications and Contract Documents. 

No bid security is required to be submitted for this solicitation. 

A sealed proposal may be mailed or otherwise delivered to the Goshen Board of Public Works and Safety, c/o Clerk-Treasurer’s Office, 202 South Fifth Street, Goshen, Indiana 46528, provided the proposal is received by 3:45 p.m. on January 23, 2025. After 3:45 p.m. and up until 4:00 p.m. on January 23, 2025, a bidder may personally deliver a sealed proposal to the Goshen Board of Public Works and Safety in the City Court Room/Council Chambers at the Goshen Police & Court Building, 111 East Jefferson Street, Goshen, Indiana. All proposals timely received will be publicly opened and read aloud by the Goshen Board of Public Works and Safety at the 4:00 p.m. meeting on January 23, 2025. Any proposal received after the applicable deadline will be returned. 

In addition to cost, proposals will be evaluated based on whether the bidder is responsible and if the bidder’s proposal is responsive. Final Lower Elkhart River Watershed Public Meeting

Join the Elkhart River Restoration Association (ERRA) on Tuesday, December 17, 2024, at 6:30 p.m. at the Schrock Pavilion in Shanklin Park (411 W. Plymouth Ave) for an informational meeting on what was learned during the two-year project to update the Lower Elkhart River Watershed Management Plan.

The ERRA will be joined by Arion Consultants to update the public on the health of the Lower Elkhart River Watershed, share what was learned, and share information on the next steps to continue improving the health of the Elkhart River Watershed.

Completing the Lower Elkhart River Watershed Management Plan will achieve the ERRA’s goal of providing a current Watershed Management Plan for the entire Elkhart River Watershed, which will provide a foundation for future projects to build on.

Notice of Adoption of City of Goshen Ordinance 5189, An Ordinance Amending Rules for the Services of the Goshen Sewer Utility and Pretreatment Requirements and Standards

Ordinance 5189, An Ordinance Amending Rules for the Services of the Goshen Sewer Utility and Pretreatment Requirements and Standards, was passed by the Goshen Common Council on August 12, 2024, and approved and adopted by Mayor Leichty on August 12, 2024.

Ordinance 5189 sets forth the City of Goshen’s regulations governing the services of the Goshen Sewer Utility and the City’s pretreatment requirements and standards that apply to all users of the Publicly Owned Treatment Works (POTW), including the substances prohibited from being directly or indirectly discharged to the POTW by users. Ordinance 5189 is available for inspection in its entirety during regular business hours at the Goshen Clerk-Treasurer’s Office located at 202 S. Fifth Street, Goshen, Indiana.

Notice of Adoption of City of Goshen Ordinance 5184

Authorizing the Use of Off-Road Vehicles on Highways under the Jurisdiction of the City of Goshen, Indiana and Imposing Requirements for Such

      Ordinance 5184, Authorizing the Use of Off-Road Vehicles on Highways under the Jurisdiction of the City of Goshen, Indiana and Imposing Requirements for Such, was passed by the Goshen Common Council on July 8, 2024, and approved and adopted by Mayor Leichty on July 11, 2024.

      Ordinance 5184 sets forth the requirements for the operation of an off-road vehicle upon the highways under the jurisdiction of the City of Goshen, including the rules of operation, minimum safety equipment required, requirements of the operator and owner, financial responsibility of the operator, and the registration of the off-road vehicle with the State of Indiana.  The City may enforce a violation of Ordinance 5184 in the City’s Ordinance Violation Bureau with a penalty of $175 for a first offense, $225 for a second offense in a 12-month period, and $250 for a third offense in a 12-month period.  The City may also enforce Ordinance 5184 by filing an action in any count of general jurisdiction to recover a fine as specified by the Ordinance based on the nature of the violation.  In addition, a person who violates Ordinance 5184 may be subject to impoundment of the off-road vehicle.

Notice of Adoption of City of Goshen Ordinance 5192, Authorizing the Use of Golf Carts on Highways under the Jurisdiction of the City of Goshen, Indiana and Imposing Requirements for Such

      Ordinance 5192, Authorizing the Use of Golf Carts on Highways under the Jurisdiction of the City of Goshen, Indiana and Imposing Requirements for Such, was passed by the Goshen Common Council on July 8, 2024, and approved and adopted by Mayor Leichty on July 11, 2024.

      Ordinance 5192 sets forth the requirements for the operation of a golf cart upon the certain highways under the jurisdiction of the City of Goshen, including the rules of operation, minimum safety equipment required, requirements of the operator and owner, and financial responsibility of the operator.  The owner of the golf cart is required to obtain a valid permit from the City of Goshen, which shall require payment of a $50 application fee and inspection of the golf cart.  A golf cart shall not be operated on a highway designated as part of the State of Indiana Highway System, nor upon any highway that has a speed limit of 35 mph or more.  The City may enforce a violation of Ordinance 5192 in the City’s Ordinance Violation Bureau with a penalty of $175 for a first offense, $225 for a second offense in a 12-month period, and $250 for a third offense in a 12-month period.  The City may also enforce Ordinance 5192 by filing an action in any count of general jurisdiction to recover a fine not exceeding $2500.  In addition, a person who violates Ordinance 5192 may be subject to impoundment of the golf cart and/or revocation of a permit issued under the ordinance.

Public Notice: Johnston Street and Hackett Road Reconstruction – Notice of Intent

The City of Goshen (204 E. Jefferson Street, Suite #1, Goshen, Indiana 46528) will be submitting a Notice of Intent (NOI) letter to notify the Indiana Department of Environmental Management (IDEM) of their intent to comply with the requirements of the Indiana Construction Stormwater General Permit (CSGP) to discharge stormwater from construction and land disturbing activities associated with the reconstruction of the Johnston Street and Hackett Road roadways.

The project is located on the west side of N Main Street (SR 15) along Johnston Street to the intersection with Hackett Road and north along Hackett Road to the intersection with N Main Street. It is located in the NE 1/4 of Section 4, Township 36 N, Range 6 East, in Elkhart Township, Elkhart County, Indiana.

Runoff from the project will flow into the public storm sewer that drains to Rock Run Creek to the southwest.

Notice of Adoption of Ordinance 5185, An Ordinance of the Common Council of the City of Goshen to Establish a Process to Address Chronic Disorderly Properties

Ordinance 5185, An Ordinance of the Common Council of the City of Goshen to Establish a Process to Address Chronic Disorderly Properties, was passed by the Goshen Common Council on June 10, 2024, and approved and adopted by Mayor Leichty on June 28, 2024.

Ordinance 5185 establishes a regulatory framework to address chronic unlawful and/or nuisance activity occurring at a property during a 30-day period.  Ordinance 5185 sets forth the activities that are considered Prohibited Conduct and what deems a Property to be a Disorderly Property and public nuisance.  If it is determined that sufficient and proper cause exists to deem a property a Disorderly Property and a public nuisance, the City may file an action in any court of general jurisdiction against the owner and/or occupants to enjoin the nuisance and to recover a fine.  The fine for a first violation is $2,500, and a second and each subsequent separate violation is $7,500.

POTW Pretreatment Program

      The City of Goshen Wastewater Treatment Plant has requested approval of a modification to its Industrial Pretreatment Program (IPP). The proposed modification consists of revisions to the pretreatment local limits for the following pollutants:  Removing the daily maximum limit for Hexavalent Chromium (currently 0.25 mg/l); adding a daily maximum limit of 3.10 mg/l for Molybdenum (currently none);  adding a daily maximum limit of 0.50 mg/l for PCBs (currently none); adding a monthly ceiling limit of 800.00 mg/l for BOD5 with excess amounts being subject to a surcharge; adding a daily maximum ceiling limit of 1,600.00 mg/l for BOD5 with excess amounts subject to a surcharge; and changing Phosphates to Phosphorus (P) with a daily maximum limit of 10.00 mg/l with excess amounts subject to a surcharge.  All other current pretreatment local limits amounts exceeding the maximum limits subject to a surcharge remain unchanged.

      The United States Environmental Protection Agency (EPA) Region 5 has proposed to approve the pretreatment program modification. The proposed determination is tentative.

      Interested persons are invited to submit written comments on the proposed program modification. Comments should be submitted in person or mailed no later than 30 days from the date of this Public Notice.  Copies of the relevant POTW documents are available for inspection and copying at EPA and at the POTW at the addresses listed above.

      Any person may request a public hearing within 30 days of the date of the Public Notice by submitting a written request to EPA Region 5. The request shall indicate the interest of the person filing such request and the reasons why a hearing is warranted. A public hearing will be held if there is a significant degree of public interest in the proposed program modification.  Public notice of such a hearing will be circulated in the newspaper and to the parties requesting the hearing.

      If no comments to this notice are received, the proposed IPP Modification will be approved as set forth herein without changes and without further public notice. In such event, this notice shall constitute the notice of approval or disapproval required by Title 40 of the Code of Federal Regulations Part 403.11(e) and no additional notice shall be provided; the approved modification will be incorporated in the POTW’s NPDES permit by the Indiana Department of Environmental Management. Anyone who wishes to be sent a notice of the approval of the modifications should send a request for such notice to the Indiana Department of Environmental Management.

Notice of Adoption of Ordinance 5188, Fire Prevention Ordinance of the City of Goshen, Indiana

      Ordinance 5188, Fire Prevention Ordinance of the City of Goshen, Indiana, was passed by the Goshen Common Council on June 10, 2024, and approved and adopted by Mayor Leichty on June 10, 2024. 

      Ordinance 5188 sets forth the fire prevention regulations for the City of Goshen and incorporates all rules of the Indiana Fire Prevention and Building Safety Commission set forth in 675 IAC Articles 12, 13, 18, 22, and 25, including any later amendments to the Articles.  The Fire Chief, or the Fire Chief’s designee, shall have the authority to enforce these fire prevention regulations, including enforcement of the provisions of the Indiana General Administrative Rules, Indiana Fire Code, Indiana Building Code, Indiana Mechanical Code, Indiana Fuel Gas Code, Ordinance 5188, or any other rule of the Indiana Fire Prevention Building Safety Commission.  Ordinance 5188 also provides for emergency planning in crowd management; installation and maintenance of fire service features, including fire lane markings, gates or barricades, key boxes, water supply for firefighting purposes, and fire flow requirements; emergency lighting activation testing and recordkeeping requirements; and the planning, approval, installation and maintenance of fire protection systems.

      The City may enforce a violation of Ordinance 5188 in the City’s Ordinance Violations Bureau with a penalty of $175 for a first offense, $225 for a second offense in a 12-month period, and $250 for a third offense in a 12-month period.  The City may also enforce Ordinance 5188 by filing an action in any court of general jurisdiction to recover a fine not exceeding $2500.  Each day of violation may be construed as a separate offense.
