Pursuant to the provisions of the Open Door Law and Indiana Code 5-14-1.5-5, the Goshen Redevelopment Commission will be holding a public meeting on August 29, 2018 at 4:00 p.m. The meeting will be held in the Annex Conference Room 204 East Jefferson Street, Goshen, Indiana.

Notice of Adoption of Ordinances Annexing Real Estate into the City of Goshen and Notice of Remonstrance Process

The following Ordinances annexing real estate into the City of Goshen have been passed by Goshen Common Council on August 7, 2018 and approved and adopted by Mayor Jeremy Stutsman on August 9, 2018.  The Ordinances in their entirety are available for inspection during regular business hours at the Goshen Clerk-Treasurer’s Office located at 202 South Fifth Street, Goshen.

  • Ordinance 4947, County Road 28 Annexation. This annexation area consists of approximately 141 acres of real estate generally located both north and south of County Road 28, west of Old County Road 17 (Reliance Road), south of US 33, and east of County Road 15.
  • Ordinance 4948, The Gardens Sixth Annexation. This annexation area consists of approximately 7.33 acres of real estate generally located west of Mountain Ash Lane, south of Clinton Street, and east of Stephanie Street.
  • Ordinance 4949, Westoria Annexation. This annexation area consists of approximately 33.3 acres of real estate generally located both east and west County Road 19 (Greene Road), north of State Road 119, and south of Berkey Avenue.
  • Ordinance 4950, The Crossing Annexation. This annexation area consists of approximately 30.36 acres of real estate generally located south of State Road 119, west of Park Meadows Drive, and east of County Road 19.
  • Ordinance 4951, Clover Trails Annexation. This annexation area consists of approximately 47 acres of real estate generally located south of State Road 119, west of Mintcrest Drive, north of County Road 36, and east of County Road 19.
  • Ordinance 4952, Ridgewood Subdivision Annexation. This annexation area consists of approximately 22.8 acres of real estate generally located east of County Road 21 (Indiana Avenue), south of Galen Court, and north of Meadow Ridge Drive.
  • Ordinance 4953, Monroe Street Annexation. This annexation area consists of approximately 4.27 acres of real estate generally located both west and east of Hillcrest Drive and north of County Road 34 (Monroe Street).
  • Ordinance 4954, East Lincoln Avenue Annexation. This annexation area consists of approximately 12.85 acres of real estate generally located north of East Lincoln Avenue and east of North 23rd

Any owners of real property within any of the annexation areas who intend to remonstrate against a proposed annexation must complete and file remonstration petitions in compliance with Indiana Code 36-4-3.  The remonstrance petitions must be filed not later than ninety (90) days after the date this notice is published, and must be filed with the Elkhart County Auditor on or before November 15, 2018 to be valid.

A remonstrance petition may also be signed at the Goshen Building Department located at the Goshen Annex Building at 204 East Jefferson Street, Goshen, from 8 a.m. to 4:30 p.m., Monday through Friday (excluding any observed holiday), beginning August 17, 2018 to November 15, 2018.  In addition, a remonstrance petition may be signed at the Goshen Annex Building located at 204 East Jefferson Street, Goshen, on the following dates and times:  September 1, 2018 from 11 a.m. to 3 p.m.; September 15, 2018 from 11 a.m. to 3 p.m.; September 18, 2018 from 5 p.m. to 9 p.m.; September 25, 2018 from 5 p.m. to 9 p.m.; and September 27, 2018 from 5 p.m. to 9 p.m.

A remonstrance petition may only be filed by an owner of real property that:

(1)  is within the area to be annexed;

(2)  was not exempt from property taxes under Indiana Code 6-1.1-10 or any other state law for the immediately preceding year; and

(3)  is not subject to a valid waiver of remonstrance.

Notice of Adoption of Declaratory Resolution and Public Hearing

The Goshen Redevelopment Commission adopted on July 10, 2018 Resolution 42-2018, Declaratory Resolution to Amend the Economic Development Plan for the Consolidated River Race/US 33 Economic Development Area and Allocation Area. Resolution 42-2018 preliminarily adopted and incorporated into the Economic Development Plan (Plan) a Plan Supplement. Under the Plan Supplement, the Redevelopment Commission proposes to acquire 12 parcels of real estate and demolish the structures to facilitate the construction of road improvements along East Lincoln Avenue from the railroad to the eastern city limits. The Commission also proposes to acquire 15 parcels of real estate, demolish and remove structures and improvements, conduct environmental studies, and construct public infrastructure improvements necessary or desirable to promote the private redevelopment of real estate in the 1000-block of Lincolnway East. A copy of Resolution 42-2018, including the Plan Supplement with maps, is available for inspection in its entirety during regular business hours at the Goshen Redevelopment Department at 204 East Jefferson Street, Goshen, Indiana.

Written remonstrances and objections to the proposed Plan amendment can be filed with the Goshen Redevelopment Department at 204 East Jefferson Street, Goshen, Indiana 46528 until 12:00 p.m. on August 14, 2018.

The Goshen Redevelopment Commission, at a meeting on August 14, 2018 at 3:00 p.m., will hold a public hearing to receive and hear all remonstrances and objections from persons interested in or affected by the proposed Plan amendment. The hearing will be held in the City Court Room/Council Chambers at the Goshen Police & Court Building, 111 East Jefferson Street, Goshen, Indiana. After considering the evidence, the Redevelopment Commission will determine the public utility and benefit of the proposed Plan amendment and will take final action on the proposed Plan amendment.

Notice of Adoption of a Resolution and Notice of Public Hearing

The Goshen Common Council passed Resolution 2018-38 on July 3, 2018 declaring the
designation of the Middlebury Street Economic Revitalization Area in the 700-Block of Middlebury Street, Goshen, Indiana for the purpose of phasing-in certain real property taxes in connection with the redevelopment of real estate by LaCasa, Inc.

The proposed redevelopment project for which the tax phase-in would apply is for the new
construction of 20 multi-family units which will consist of 4, 5-unit buildings. The units will be
made available for rent at affordable rates to households at or below 50% area median income. As proposed, the term of the designation of the Middlebury Street Economic Revitalization Area shall be limited to a period of ten (10) years and expire in 2032. LaCasa would be entitled to make application for a deduction from the assessed value of the real property applicable to the redeveloped real estate for ten (10) years at 100% in an amount not to exceed a cost of $3,880,395.

inspected at the Elkhart County Assessor’s Office at 117 North Second Street, Goshen, Indiana.
Resolution 2018-38 in its entirety may also be inspected during regular business hours at the Goshen Clerk-Treasurer’s Office at 202 South Fifth Street, Goshen, Indiana

The Goshen Common Council, at a meeting on July 17, 2018 at 7 p.m., will hold a public
hearing to receive and hear all remonstrances and objections from interested persons concerning this designation. The hearing will be held in the City Court Room/Council Chambers at the Goshen Police & Court Building, 111 East Jefferson Street, Goshen, Indiana. After considering the evidence, the Common Council will take final action in determining whether the qualifications for an economic revitalization area have been met, and will then confirm, modify and confirm, or rescind Resolution 2018-38.

NOTICE OF PUBLIC HEARING

Notice of Public Hearing for the Goshen Community Schools
Annexation into the City of Goshen

A Petition for Annexation into the City of Goshen has been filed with the Goshen Common Council requesting the annexation of certain real estate located outside the corporate limits of the City of Goshen.  This area is identified as the “Goshen Community Schools Annexation Area” and consists of approximately 37 acres of real estate generally located north of State Road 119, west of Greene Road (County Road 19), and south of Berkey Avenue.  The Goshen Common Council will conduct a public hearing on the Goshen Community Schools Annexation at its regular meeting on August 7, 2018 at 7 p.m.  The hearing will be held in the City Court Room/Council Chambers at the Goshen Police & Court Building, 111 East Jefferson Street, Goshen.  All interested members of the public are invited to attend and will be given the opportunity to testify on the proposed annexation at the public hearing.

Pursuant to the provisions of the Open Door Law and Indiana Code 5 14 1.5 5, the Goshen Parks and Recreation Board will be holding a public meeting on July 2, 2018 at 4:00 p.m. The meeting will be held at the Rieth Interpretive Center, 410 West Plymouth Avenue.

JUNE BRUSH PICKUP BEGINS JUNE 25

Brush pickup for the month of June is next week. During scheduled brush collections, the Street Department will make only one pass through the city to pick up brush. Please have your brush by the front curb, but not in the street, by that Monday morning at 7:00 am. Brush will not be picked up in alleys and the piles should be trash free. Crews cannot access the piles if blocked by vehicles.

Please remember the Street Department DOES NOT collect grass clippings. Please do not pile them up on the curb with the rest of the brush.

Notice of Adoption of Ordinance 4959, Keystone RV Company Annexation

Ordinance 4959, Keystone RV Company Annexation, was passed by the Goshen Common Council on May 15, 2018 and approved and adopted by Mayor Jeremy P. Stutsman on May 18, 2018.  The annexation area consists of approximately 32 acres of real estate generally located north of Woodfield Road (County Road 40), east of Corrie Drive, south of Skyview Road, and west of US 33.  Ordinance 4959 in its entirety is available for inspection during regular business hours at the Goshen Clerk-Treasurer’s Office located at 202 South Fifth Street, Goshen, Indiana.
