Notice of Adoption of Resolution Designating the “Goshen Assisted Living Economic Revitalization Area” and Notice of Public Hearing

Pursuant to I.C. 6-1.1-12.1-2.5, notice is given that the Goshen Common Council passed Resolution 2017-19 on September 5, 2017 declaring the designation of an economic revitalization area for the purpose of phasing-in certain real estate taxes in connection with the construction of an assisted living facility by Goshen Assisted Living, LLC (“Applicant”). This area, which is located at 2440 South Berkshire Drive, Goshen, Indiana 46526, is identified as the “Goshen Assisted Living Economic Revitalization Area.” A map and description of the affected area is available and can be inspected at the Elkhart County Assessor’s Office at 117 North Second Street, Goshen, Indiana or Goshen City Clerk Treasurer’s Office, 202 S 5th Street, Goshen, Indiana.

Notice is given that the Goshen Common Council, at a meeting on October 3, 2017 at 7:00 p.m., will hold a public hearing to receive and hear all remonstrance and objections concerning this designation from interested persons. The hearing will be held in the City Court Room/Council Chambers at the Goshen Police & Court Building, 111 East Jefferson Street, Goshen, Indiana. After considering public comment, the Common Council will take final action to determine whether the qualifications for an economic revitalization area have been met, and may confirm, modify, or rescind the previously adopted declaratory resolution.

If the declaratory resolution is confirmed by the Common Council, the designation of the Goshen Assisted Living Economic Revitalization Area shall be limited to a period of seven (7) calendar years. The Applicant will be entitled to make application for a deduction from the assessed value of the real estate taxes on the designated economic revitalization area in an amount not to exceed Fifteen Million Five Hundred Thousand Dollars ($15,500,000) and for no more than seven (7) years.

NOTICE OF ADOPTION OF ORDINANCE 4919

Ordinance 4919, An Amendment to the Building Department Fee Ordinance, was passed by the GoshenCommon Council on August 15, 2017 and approved and adopted by Mayor Stutsman on August 22, 2017. Ordinance 4919 establishes a $250 fee for a separate foundation permit so that the foundation can be constructed prior to the issuance of a residential or commercial building permit for the rest of the construction, alteration, remodeling or rehabilitation. Ordinance 4919 is available for inspection in its entirety during regular business hours at the Goshen Clerk-Treasurer’s Office located at 202 South Fifth Street, Goshen and the Goshen Building Department located at 204 East Jefferson Street, Goshen.

NOTICE OF ADOPTION OF ORDINANCE 4917

Ordinance 4917, Amend Noise Control, was passed by the Goshen Common Council on July 18, 2017 and approved and adopted by Mayor Jeremy Stutsman on July 20, 2017. Ordinance 4917 amends Goshen City Code Title 3, Article 3, Chapter 1, Section 1, by adding the following language, “An owner of real estate, and an owner or manager of a business in the B2 zoned area shall prevent the amplification of sound from being heard from outside the boundaries of the real estate parcel between the hours of 12 a.m. to 7 a.m.” This ordinance shall sunset July 17, 2018. Ordinance 4917 is available for inspection in its entirety during regular business hours at the Goshen Clerk-Treasurer’s Office located at 202 South Fifth Street, Goshen, Indiana.

NOTICE OF ADOPTION OF ORDINANCE 4911

Ordinance 4911, Amend the Local Limits for Mercury, was passed by the Goshen Common Council on July 18, 2017 and approved and adopted by Mayor Jeremy Stutsman on July 20, 2017. Unless otherwise limited or authorized by the Board of Public Works and Safety and incorporated into a discharge permit, no user may discharge wastewater containing concentrations of mercury exceeding the daily maximum of 370 nanograms per liter. Ordinance 4911 is available for inspection in its entirety during regular business hours at the Goshen Clerk-Treasurer’s Office located at 202 South Fifth Street, Goshen, Indiana.
